CONTRACTUAL TERMS AND CONDITIONS

By purchasing this ticket and participating in the event, you, as the “Participant”, accept, for yourself and for any assignees, the following contractual terms and conditions, effective from the date of purchase of the ticket.

Soma Concepts & Activation, Lda., with registered office at Praceta da Tabaqueira A2, 1950-256 Lisbon, Portugal, registered under VAT number PT513446885, hereinafter referred to as “Soma” or the “Organiser”, produces lifestyle, yoga, meditation, wellbeing and related experience events under the “Wanderlust” brand, including, but not limited to, events such as “Wanderlust”, “Wanderlust Festival”, “Wanderlust 108”, “Wanderlust Connect” or “Wanderlust Sunset”, hereinafter referred to individually as the “Event” and collectively as the “Events”.

The activities in which the Participant may choose to take part, according to the type of ticket purchased, before, during or after each Event, include, but are not limited to, yoga, meditation, acrobatic yoga, stand up paddle, surfing, swimming, trekking, cycling, running, fitness, dance, outdoor activities and other wellbeing experiences, hereinafter collectively referred to as the “Activities”, as well as any remote or digital participation in such Activities.

1. Ticket Purchase

1.1. The Organiser may sell tickets directly or through authorised ticketing platforms, including, but not limited to, Easol and Ticketline.

1.2. Whenever the ticket is purchased through an external platform, any request arising from the purchase, including, but not limited to, matters related to payment, issue, delivery, collection, amendment, non-receipt or replacement of tickets, must be addressed directly to the respective ticketing platform.

1.3. Easol, Ticketline or any other authorised ticketing platform shall respond in accordance with their own operating procedures, terms and conditions, refund policies and customer support channels, over which the Organiser may not have direct control.

2. Access to the Event Area

2.1. The Event ticket constitutes an access title exclusively for the day, time, location and type of experience for which it was issued.

2.2. The Organiser may deny access to the Event area, or remove from the Event, any participant holding tickets that were not issued by authorised ticketing systems, or tickets that are false, duplicated, altered or otherwise irregular, while also reserving the right to act in defence of its rights in cases of forgery, fraud, misuse or abuse of any kind.

2.3. The Participant undertakes to comply with the instructions of the production team, security staff, assistants, activity leaders and any other authorised personnel present in the Event area.

2.4. The Organiser reserves the right to carry out security checks through the security service and to remove the Participant from the Event area in the event of a serious breach of these contractual terms, violation of legal provisions, failure to comply with instructions from competent authorities or behaviour that may endanger the safety, integrity, tranquillity or normal running of the Event.

3. Participation Conditions

3.1. Participation in the Event implies full acceptance of these contractual terms and conditions.

3.2. The Participant must always behave responsibly, respectfully and appropriately within the context of the Event, respecting other participants, the production team, teachers, instructors, artists, partners, sponsors, suppliers and all other entities involved.

3.3. The Organiser reserves the right to refuse entry to, or remove from the Event, any Participant who behaves in an offensive, aggressive, discriminatory, dangerous, disrespectful manner or in a way that is contrary to the spirit of the Event.

4. Minimum Age

4.1. Unless expressly stated otherwise, certain Activities within the Event may be reserved for Participants who are at least eighteen years old.

4.2. Participation by minors may be subject to authorisation from parents or legal guardians, supervision by a responsible adult or specific conditions defined by the Organiser for each Event.

5. Risks of the Activities

5.1. The Participant declares that they are aware of the potential risks inherent in participating in the Activities, including physical, sports, wellbeing, meditation, yoga, dance, outdoor or other experiences included in the Event.

5.2. The Participant acknowledges that some Activities may require physical effort and that, in certain circumstances, they may cause discomfort, fatigue, injuries, changes in blood pressure, dizziness, fainting, heart rhythm disturbances or other physical effects.

5.3. The Participant undertakes to immediately stop any Activity and request assistance if they experience pain, discomfort, dizziness, breathing difficulty, physical distress or any other symptom that may compromise their safety or wellbeing.

5.4. The Participant declares that they participate in the Activities voluntarily, freely and consciously, assuming the normal and foreseeable risks associated with their participation, including possible damage to personal belongings, personal injury or other incidents arising from the practice of the Activities.

6. Participant Health Conditions

6.1. The Participant declares that they are in suitable health condition to participate in the Activities they choose.

6.2. The Participant declares that they are not aware of any physical, medical or psychological condition that could pose a risk to themselves or to third parties during participation in the Event.

6.3. If the Participant has any doubts about their physical condition or fitness to participate in any Activity, they should consult a qualified healthcare professional beforehand.

6.4. The Organiser is not responsible for verifying the Participant’s physical or medical fitness to participate in the Activities.

7. Exemption of Liability of the Organiser for Damage Suffered by the Participant

7.1. The Participant acknowledges that they participate in the Event and in the Activities voluntarily and consciously.

7.2. To the extent permitted by law, the Participant releases the Organiser, promoting entities, sponsors, partners, suppliers, owners or managers of the venues where the Events take place, their respective companies, directors, employees, contractors, volunteers and successors, hereinafter referred to as the “Released Parties”, from liability for damages, injuries, losses or harm arising from their participation in the Activities, except where such damage results from wilful misconduct or gross negligence directly attributable to the Released Parties.

7.3. In particular, the Participant acknowledges that the Released Parties shall not be liable for injuries, discomfort or damage arising from the voluntary practice of the Activities, from the use of structures installed for the Event, or from situations resulting from the Participant’s own conduct, the conduct of third parties or circumstances beyond the reasonable control of the Organiser.

7.4. The Organiser shall not be liable for loss, theft, robbery or damage to the Participant’s personal belongings, including items left in common areas, cloakrooms, support areas, lockers, mats, bags, practice areas or any other spaces within the Event, unless otherwise provided by law.

8. Consent for Image Capture, Publication and Use

8.1. The Participant acknowledges that the Event may be photographed, filmed, recorded or broadcast, in whole or in part, by the Organiser, its partners, sponsors, suppliers or entities authorised by it.

8.2. By participating in the Event, the Participant authorises, under the legally applicable terms, the capture and use of their image, voice and presence in photographs, videos, audiovisual recordings, digital content, promotional materials, social media, websites, press, commercial presentations, institutional content or other communication channels related to the Event, Soma, the Wanderlust brand or future editions.

8.3. This authorisation is granted free of charge, for use in Portugal and abroad, in any format or medium, physical or digital, including websites, social media, video platforms, advertising, public relations, press, commercial presentations and communication materials.

8.4. Whenever the Participant’s image is captured individually, prominently or used for purposes that go beyond the normal coverage of the Event, the Organiser may request additional consent, where legally applicable.

8.5. The Participant may contact the Organiser at hello@somalisboa.pt if they have any questions regarding the use of their image.

9. Ticket Transfer to Third Parties

9.1. Unless otherwise stated, the Event ticket may be transferred to third parties, provided that the person to whom the ticket is transferred meets the age, participation and other requirements applicable to the Event.

9.2. It is strictly prohibited to offer Event tickets as prizes in promotions, competitions, commercial actions or campaigns not authorised by the Organiser.

9.3. The transferor declares that they will inform the assignee of these contractual terms and conditions and shall hold the Organiser harmless from any claim arising from the assignee’s lack of knowledge of these conditions.

10. Changes to the Event

10.1. The Event programme, schedules, activities, teachers, instructors, artists, guests, partners and other announced content are valid at the time of publication but may be changed by the Organiser at any time for technical, operational, meteorological, artistic, logistical, legal, safety or force majeure reasons.

10.2. The Organiser may change the date, location, time, format or any element of the Event for reasons of force majeure or for technical, organisational, legal, safety or operational reasons.

10.3. For the purposes of these terms, force majeure includes, among others, adverse weather conditions, natural phenomena, strikes, impossibility of using the venue, revocation or amendment of authorisations, legal impositions, orders from competent authorities, public health situations, security risks, relevant technical failures or other events beyond the reasonable control of the Organiser.

10.4. Relevant changes will be communicated through the Event’s official channels, including the website, email, social media or ticketing platform, where applicable.

10.5. Changes to schedules, programme, specific activities, teachers, artists, guests or partners shall not, in themselves, entitle the Participant to a refund.

11. Event Cancellation

11.1. Unless otherwise stated, the Event may take place even in the event of rain, bad weather or other adverse weather conditions, provided that the minimum safety and legal conditions for its realisation are met.

11.2. If the Event is cancelled by decision of the Organiser, by legal imposition, by order of a competent authority or due to force majeure that prevents its realisation, the applicable conditions will be communicated to the Participants, including possible rescheduling, credit, voucher or refund, according to the specific situation and applicable law.

11.3. Unless legally required, the cancellation of individual activities, programme changes, replacement of teachers, instructors, artists or guests, or schedule changes shall not automatically entitle the Participant to a ticket refund.

11.4. Service fees, commissions, administrative costs or other charges collected by external ticketing platforms may be subject to the terms and conditions of those platforms and may not be refundable, unless otherwise provided by law.

12. Refund Policy

12.1. Refund requests must be made through the platform where the ticket was purchased, where applicable.

12.2. The Organiser may define specific refund policies for each Event, which will be communicated at the time of purchase or through the Event’s official channels.

12.3. Unless expressly stated otherwise or required by applicable law, refunds will not be issued due to the Participant’s inability to attend, delay, voluntary departure from the Event, change of personal plans or non-participation in specific activities.

13. Personal Data

13.1. The processing of Participants’ personal data shall be carried out in accordance with the General Data Protection Regulation (EU) 2016/679, applicable Portuguese legislation and the Organiser’s Privacy Policy.

13.2. Personal data may be used for registration management, ticket issuing, access control, Event-related communications, customer support, invoicing, security, compliance with legal obligations and, where applicable, marketing communications subject to consent.

14. Applicable Law and Jurisdiction

14.1. These contractual terms and conditions are governed by Portuguese law.

14.2. In the event of any dispute arising from the interpretation or execution of these terms, the legally competent court under Portuguese law shall have jurisdiction.
